Conditions of use

Welcome to the SGH Martineau Website. This document is a legal Agreement which describes the conditions of use applicable to your use of the Websites.

1. Definitions

1.1 In this Agreement the following words and expressions shall have the following meanings:

"Agreement" these Conditions of Use and the Privacy Policy
"Content" all the content contained in the Websites from time to time
"SGH Martineau" SGH Martineau Solicitors (a partnership) of No 1 Colmore Square, Birmingham B4 6AA United Kingdom
"Personal Information" personal information relating to You
"Privacy Policy" the privacy policy set out here
"Websites" the websites owned and operated by SGH Martineau which can be viewed at www.sghmartineau.com, www.educationsolutionsonline.co.uk and www.climatechange-forum.co.uk together with any other website owned and operated by SGH Martineau from time to time
"Words and Logos" the words "SGH Martineau", "Education Solutions Online", "Climate and Change Forum" and their associated logos
"You & Your" any user of the Website

2. Provision of Content

2.1 The Content on the Websites is for general information only and does not constitute advice on any specific matter. Whilst SGH Martineau makes every effort to ensure that the Content is accurate and up to date, no representation or warranty, express or implied, is made as to the accuracy or completeness of any Content.

2.2 Content which relates to the law and legal developments are based upon the laws of England and Wales unless otherwise stated.

2.3 Content is based on certain facts and assumptions. Advice derived from the Content may not be applicable to different sets of circumstances and therefore You should always seek appropriate legal advice from one of our lawyers before taking or refraining from taking any action.

2.4 The information on the Websites is offered exclusively for users who are not legal practitioners in private practice. SGH Martineau reserves the right to bar access to users who it reasonably believes are legal practitioners in private practice or who otherwise abuse the services provided by the Websites.

2.5 You agree to comply with all applicable laws and regulations when using the Websites.

2.6 You must not use the Websites to send any e-mails for chain letters, commercial solicitation, mass mailing, or any other form of spam.

2.7 You may download and print one copy of the Content, provided that You retain all credits and copyright notices associated with the original of such Content.

2.8 Without prejudice to Paragraph 2.7 You may not reproduce, distribute, transmit or otherwise exploit the Content in any way. In particular, You may not include the Content in any other publication or on any other websites or computer network otherwise than in accordance with the limited reproduction permission set out at Paragraph 4 and/or the prior written permission of SGH Martineau. In addition, You must abide with all other terms, conditions and restrictions contained in any other agreement associated with the Content.

3. Your Personal Information

3.1 If You wish to contact SGH Martineau by email or request further information you will be required to submit Personal Information to SGH Martineau.

3.2 The Personal Information you submit to SGH Martineau will only be used by SGH Martineau in accordance with the Privacy Policy.

3.3 You hereby undertake to notify SGH Martineau in writing in the event of any change in your Personal Information.

3.4 SGH Martineau will not collect sensitive personal information relating to your sex, health, racial or ethnic origin, political or religious beliefs without Your explicit consent.

4 Ownership of the Website and Copyright Notice

4.1 The Content and Websites are protected by UK and International copyright and are the copyright of SGH Martineau unless otherwise stated. Reproduction of any of the Content and/or Website is prohibited other than in accordance with the limited reproduction permission set out in this Paragraph 4. All rights are reserved.

4.2 Except as expressly provided in this Agreement, You may not copy, reproduce, re­publish, lease, sub- licence, download, post, broadcast, transmit, modify, create works from, or in any way, commercially exploit any of the Content.

4.3 In particular but without limiting the generality of the above, you may not do any of the following without the prior written permission of SGH Martineau:

4.3.1 redistribute any of the Content (including by using it as part of any library, archive or similar service);

4.3.2 remove the copyright notice from any copies of the Content;

4.3.3 create a database in electronic or manual form by systematically downloading and storing all or any of the Content; or

4.3.4 create a link to the Websites or Content.

4.4 Requests to re-publish and/or re-distribute any Content should be addressed to SGH Martineau as set out at Paragraph 1.

4.5 The names and logos of other companies referred to in the Website may be the trademarks of their respective owners. You may not use any trademark or logo appearing on the Website without the prior written consent of the owner of the relevant trademark or logo.

5 Liability and Warranty

5.1 SGH Martineau warrants that it will use reasonable care and skill in preparing and presenting the Content. All other warranties express or implied, statutory or otherwise are hereby excluded to the extent permitted by law and in particular, SGH Martineau does not warrant that the Website operates error and/or virus free or operates without interruption or is compatible with all equipment and software configurations.

5.2 SGH Martineau hereby excludes to the extent permitted by law any and all liability for any loss or damage howsoever arising out of the use of the Websites or reliance upon the Content.

6 Insurance Mediation

6.1 SGH Martineau is not authorised by the Financial Services Authority. However, we are included on the register maintained by the Financial Services Authority so that we may carry on insurance mediation activity, which is broadly the advising on, selling and administration of insurance contracts. This part of our business, including arrangements for complaints or redress if something goes wrong, is authorised and regulated by the Solicitors Regulation Authority. The register can be accessed via the Financial Services website at www.fsa.gov.uk.

The Law Society of England and Wales is a designated professional body for the purposes of the Financial Services and Markets Act 2000. The Solicitors Regulation Authority is the independent regulatory arm of the Law Society. The Legal Ombudsman deals with complaints against lawyers. If you are unhappy with any insurance advice you receive from us, you should raise your concerns with either of those bodies.

7 General

7.1 From time to time SGH Martineau may include links to third party websites. Such links are provided for information only. SGH Martineau does not accept responsibility for the content of any of the link websites and does not accept any duty of care in respect of and nor does it make any representation express or implied in relation to the accuracy or reliability of the content of any link website; nor does the existence of any link constitute any implied endorsement of any website, its sponsor, its products or its services nor should any views expressed on that website be taken to reflect the views of SGH Martineau.

7.2 This Agreement (together with the Privacy Policy) contains the entire agreement and understanding between the parties relating to the subject matter of this Agreement, and (in relation to that subject matter) supersedes any and all prior agreements, arrangements, statements and understandings.

7.3 If any term or provision in this Agreement shall be held to be illegal or unenforceable, in whole or in part, under any enactment or rule of law, such term or provision or part shall to that extent be deemed not to form part of this Agreement but the validity and enforceability of the remainder of this Agreement shall not be affected.

7.4 Use of the Websites by You shall constitute Your acceptance of this Agreement.

7.5 This Agreement shall be governed by the laws of England and Wales and the parties submit to the exclusive jurisdiction of the English Courts.
